STANDARD TERMS AND CONDITIONS OF DELIVERY

THESE ARE THE TERMS AND CONDITIONS OF DELIVERY THAT APPLY TO THE PRODUCTS OF MOBILEMONEY. PLEASE READ THESE STANDARD TERMS AND CONDITIONS CAREFULLY BEFORE USING OUR SERVICE.

BY USING OUR PRODUCT, YOU AGREE WITH THESE TERMS AND CONDITIONS AND YOU ARE AWARE OF YOUR RIGHTS AND OBLIGATIONS AS INCLUDED IN THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, DO NOT USE OUR PRODUCT.

MOBILEMONEY reserves the right to amend, add to and/or remove from the Terms and Conditions and/or Articles. It is the user’s responsibility to read these Terms and Conditions before every purchase.

Definition of Terms
1. MobileMoney: a product of Techno Design Internet Programming B.V., a private company with restricted liability company with its registered office at Koraalrood 100, 2718 SC in Zoetermeer, the Netherlands, operating with VAT no NL809888737B01, registered with the Chamber of Commerce in Haaglanden under number 27197080.

2. Product: MobileMoney ensures the provision of mobile and on-line entertainment goods and services that are delivered by means of, but not exclusively, SMS, IVR, PayPal and Credit-card payments.

Article 1: Scope
1. These Terms and Conditions apply to all products and deliveries by whichever name.

2. It is not possible to deviate from that stated in these Terms and Conditions in any way.

3. Where these Terms and Conditions refer to ‘delivery’, this also includes providing services and activities of whichever nature.

Article 2: Access
1. In order to make use of our products, you have to be at least 18 years of age or you have to be authorised by the account holder to make payments.

2. It is essential for the correct delivery of the products that the final destination of the product has the right settings.

3. It is the buyer’s responsibility to ensure that the product purchased is downloaded in time. If the product is delivered by means of an SMS, the mobile provider determines how long they will store an SMS that was sent but not received. MobileMoney does not have any responsibility or liability in this respect.

Article 3: Privacy
1. If personal details are provided, these shall only be used for internal purposes. MobileMoney does not issue personal details to third parties, nor permits this, unless stated otherwise. Internal purposes refer to activities that contribute to improving the service for the buyer.

2. MobileMoney does everything possible and everything required by law to protect the buyer’s privacy.

Article 4: Liability
1. The products that are delivered by MobileMoney to the buyer do not have any guarantees from MobileMoney or third parties other than the guarantees noted in these Terms and Conditions and required by the law applicable to these Terms and Conditions.

2. MobileMoney does not guarantee the use or the results of the use of the products or the content in relation to execution, promptness, confidentiality, safety requirements, current ness, or otherwise.

3. MobileMoney is not responsible for damage that is the result of the buyer’s access to the products, including the use of the products and/or downloads.

Article 5: Ownership
1. Every product on the website is owned by MobileMoney or its entitled parties. This includes the software that is used in combination with the products.

2. Under no conditions may the products or its parts be changed, rented, leased, loaned, sold, distributed or derived from the original and/or the software that is owned by MobileMoney and its entitled parties.

Article 6: Prices
1. The prices that are shown on the order are the actual consumer prices, including VAT, unless legally required otherwise. This does not take account of any call charges, SMS and/or WAP charges.

Article 7: Changes
1. MobileMoney reserves the right to amend and/or supplement these Terms and Conditions. When the product originating from MobileMoney is used, this implies agreement with these Terms and Conditions and implies that the buyer is aware of the rights and obligations included in these Terms and Conditions.

2. These Terms and Conditions form part of any terms and conditions and clauses of MobileMoney and third parties that apply to the products.

3. When any part of these Terms and Conditions is declared invalid and/or unworkable, this shall be redressed in a consistent manner in accordance with the applicable law. The Terms and Conditions shall continue to exist, excepting the invalid and/or unworkable part or parts, and all rights and obligations shall remain in force.

Article 8: Applicable Law
1. This Agreement is governed by Dutch law and jurisdiction. Any dispute that may arise as a result of this Agreement shall be put before the Court in Rotterdam.
